Am I liable ?
Hello, first time poster, so go easy please !
Had my o2 phone nicked in mexico 2 weeks ago. Reported to the hotel. Bought a phone card and rang it - Unobtainable, so I presumed whoever had it, had thrown the sim card out and kept the handset. Only when I returned to the uk yesterday, rang o2 to report, they said my current bill was £1336. They suggested ringing my holiday insurance to see if they will put some money towards the cost, but I reckon that is unlikely (Claim form on its way anyway) buy basically said I was liable. However reading section 5.5 of the TOC's shouldn't they have spotted the fraudulent activity and put a temporary block on it ? My bill is normally £20 - £25. Any suggestions welcome, Thanks, Chris |

.
Unless you have an insurance policy which covers airtime abuse than you are liable. It would be your responsibility to contact O2 as soon as you lost your phone to put a bar on it. As far as they are concerned you could have been on a long business trip!
Bad news, sorry mate. You could try proving you were back in the UK when the fraudulant calls were made, get bills from o2 and show them proof that you were in UK when calls were made in Mexico |
