Smile Was scammed on eBay..bought KRZR phone that was stolen. Help

Hi all....earlier this week I purchased a K1m on eBay. Turns out it was a scam...the phone was stolen. I checked with Verizon & they verified it. I located the original owner from the numbers in the phone. They had already bought another but want the phone back... but I paid for it & have no legal obligation to return it and take a total loss...I offered to take a 50% loss & offered to return it.

They won't cooperate saying I should eat all the $ and give it back. So, the police told me I can keep it & have committed no wrong. I either sell it for parts or find a way to get the ESN my question is CAN the phone be unlocked or am I screwed all the way around.

The phone is in near-perfect shape and it would be a waste to just trash it or sell it on eBay for parts. Any help or suggestions would be much appreciated.

This is becoming an all too familier issue on fones bought from auction sites such as e bay.

Purchased using hard earned money and then are turned off as they are under a fraud investigation ie bought under a contract under dodgy details etc or the owner actually reporting it lost or stolen to claim on insurance to get an upgrade etc etd.

If the imei has been blocked by the network then you have ended up with whats basically an expensive paper weight.

Launch an immediate dispute with e bay abd paypal if you used them to pay.

And yes u do have a legal responsability to retuen the handset to the owner or network even tho you paid good money for it. In the eyes of the law you do not own the handset.
