help with phone contract can i cancel it
I took a phone contract out on the 19th may 2008, nokia 6500 slide black on orange.
The phone wasn't for me it was for my house mate, your staff convinced me into taking it out in my name for him as he did not have a debit/credit card.
We was told as soon as we left the shop with the phone we could not bring it back if we decided we didn't want it, he made it very clear there was no 14 day cooling off period,
also stated this in the contract.
The staff gave us the contract paper to take home which they was meant to keep, they phoned us asking us to bring it down which i never did they should do there job right.
We then found out by the same man a month later there was a 14 day cooling off period and he denied saying this to us, we checked the contract as week wanted out that night as online you can get a the same deal with a free gift worth £240.
I think it was a couple of weeks later the phone broke and would not turn on, it got red hot when it was on.
We took the phone back to the shop for repair which took a month to fix, when the phone was ready to my shock they gave us a charger that was in 2 bits with blue tape holding it together
(fire hazard) the phone which was black when i got it now had a silver back, nokia 6500 either come in black or silver not mixed.
The phone did the same thing as the first phone the same night and would not work.
So the phone went back to the shop again, took another month to be fixed.
when we finally get the phone back it had no back and the same broken charger.
The staff tried telling me it was a new phone and they forgot to send the back and they will ring me when its turned up.
I know it is not a new phone as i have phoned nokia head office and they told me it was a second hand replacement phone as they was not able to repair mine.
The staff looked confused when i told them this and did not know what to say.
nokia told me they only had the phone for 9 days out the the 2 months it took to fix the phone

First thing to check is your contract small print again about the cooling off period. In my experiance all contracts have this wether it's 14 or 28 days. If it states a no cooling off period then you can challenge this. If it ford say you have then it's your word against the reps.
Speak to the store manager in respect to the unacceptable state of the handset and have this ready in writing to give this to him or her. Use facts and a clear concise avenue of resolvememt you want. Don't threat or shout in the store. Keep your voice calm and steady and also give a time frame on when this should be resolved. Ask for a new handset . Also ask for customer service's e mail , address and tel number along with the companies CEO name. Ask for the industries ofcom details too.
Asking for all this will show them your resolve.
In the uk places like citizens advice can help and you can also take the company to a small claims court.
The sales of goods act is their to protect u if an item purchased does not function for the reason it was described at the point of sale.

Usually you can't come out of the contract until it expire.. you have to put forward a request to your SP and terminating contract will end up in contract termination fee.. Instead you can simply change carrier by unlocking your phone from any vendors online like Prounlocking.com
